Beyond B&B:  A New Regime for Litigation Strategy?

On December 2, 2014, the Supreme Court heard oral arguments in B&B Hardware, Inc. v. Hargis Industries, Inc. In this case, the Court will decide whether findings in TTAB proceedings have preclusive effect in later district court proceedings, or, if not, whether any deference should be given to such findings, and under what circumstances.
Join United States District Court Judge Marvin J. Garbis from Maryland, David S. Welkowitz, Professor at Whittier Law School in Costa Mesa, CA, Nancy Mertzel from Schoeman Updike Kauffman & Stern in New York, and Kenneth L. Wilton from Seyfarth Shaw, LLP, in Los Angeles, CA, for their perspectives on the importance and potential consequences of this case for trademark litigation, as well where deference is at issue in other contexts.
TTAB Administrative Judge Lorelei Ritchie will moderate the panel.
